TENANT HOLDING OVER

THO

TENANT HOLDING OVER

So you have a tenant to whom you issued a proper 60-day notice to vacate, their lease has expired, but they still refuse to leave the property. In this situation, you aren’t necessarily requesting past-due rent; you simply want the tenant out and your property back.

This requires a specific civil action known as a "Tenant Holding Over" (THO) filing. If you have already issued the 60-day notice, we can immediately step in to file the THO action to legally remove them.

If you have not issued the 60-day notice yet—no worries! Our partnered attorneys can help you draft the proper notice and resolve this issue from start to finish.
