MILITARY SCRA CHECKS
MILITARY STATUS SCRA CHECKS
Before filing an eviction in Maryland, landlords must determine if their tenant is an active-duty member of the military.
Military members have special protections under federal law known as the Servicemembers Civil Relief Act (SCRA). These protections apply directly in rent court when it comes to evictions, default judgments, and lease terminations. You cannot simply evict a deployed servicemember for failure to pay rent without following specific federal protocols.
Our Verification Process:
As part of our filing process, we require you to declare whether your tenant is in the military. If you are unsure, Eviction Court MD can perform "skip tracing" and SCRA status checks to verify their military standing. This ensures your case is fully compliant with federal law before it ever reaches a judge's desk, protecting you from severe legal penalties.
